Form I-956G: Regional Center Annual Statement

Form I-956G, Regional Center Annual Statement, is the yearly report a designated EB-5 regional center files with USCIS. The USCIS page says designated regional centers use it to provide required information, certifications and evidence to support their continued eligibility for regional center designation.

The instructions say each approved regional center files one statement for each Federal fiscal year (October 1 through September 30). A center with a designation letter dated on or before September 30 files by December 29 of the same calendar year, and one dated on or after October 1 files by December 29 of the following calendar year. The instructions say not filing on time may lead to sanctions, including termination of the designation.

The USCIS page says Form I-956G takes the place of Form I-924A from the previous program, but incorporates the increased statutory reporting requirements.

How to fill out Form I-956G

  1. 1

Use edition 04/01/24 and black ink

Type or print legibly in black ink. The USCIS page says every page has to come from the same edition, with the edition date and page numbers visible, or USCIS may reject the form.

  2. 2

Give the fiscal year in Part 1

Select annual certification or amendment, then enter the Federal fiscal year ending September 30 in yyyy format. The instructions say Attachment 1 shows the same year.

  3. 3

Complete one Attachment 1 per NCE and project

The instructions say Attachment 1 is completed for each NCE and capital investment project with active EB-5 investors in the reporting period, and not for those that no longer have any. Copies of the attachment may be made.

  4. 4

    Describe each exhibit

Where the form asks whether documentation was submitted, such as on litigation, labor law policies, capital commitment or project progress, it asks for the exhibit number and document name.

  5. 5

Write N/A or None and use Part 8

Write N/A where a question does not apply and None for a zero. Extra answers go in Part 8 with the regional center entity's name, the page, part and item number, and a signature and date on each sheet.

  6. 6

    Sign Parts 4 and 5

Each certification in Part 4 is signed by the certifier and Part 5 by the authorized individual. A stamped or typewritten name is not accepted. This page lets you fill the form online free, then print it for signature.

Where to file, timing, evidence and fees

Where to file

The USCIS page lists a U.S. Postal Service address (USCIS, Attn: I-956G, P.O. Box 660168, Dallas, TX) and a Lewisville, TX address for FedEx, UPS and DHL deliveries. It lists no online filing option.

When to file

The instructions say a statement is due for each Federal fiscal year on or before December 29, following the table in the instructions based on the date of the designation letter.

Fee

The fee is on the USCIS Fee Schedule page (Form G-1055), which can change. Check it on the day you file. The instructions mention submitting the appropriate annual fee with the statement.

Evidence

The instructions list an accounting of all individual alien investor capital and, for each NCE, an accounting of aggregate capital, detailed evidence of project progress such as expenditures, construction photos, news articles, affidavits, permits or certificates of occupancy, an accounting of direct jobs, and any material change documents.

Address changes

The instructions say the regional center tells USCIS about a change to the regional center, NCE or JCE mailing address within 30 days by email to the EB-5 Program mailbox, and not through the USCIS Lockbox.

Copies and translations

Send legible photocopies unless originals are requested, and include a full English translation with the translator's certification for any foreign-language document. The page says USCIS rejects an unsigned form.

Who files Form I-956G?

  • Designated regional centers

The instructions say each approved regional center files Form I-956G for every Federal fiscal year in which it has been designated to take part in the Regional Center Program.

Part 4 is completed by a qualified certifier. The form describes this as a person in a position of substantive authority for the management or operations of the regional center, such as a principal executive officer or principal financial officer.

Questions about Form I-956G

What form did Form I-956G replace?

The USCIS page says Form I-956G takes the place of Form I-924A from the previous program, but incorporates the increased statutory reporting requirements.

When is Form I-956G due?

The instructions say each approved regional center files it for each Federal fiscal year on or before December 29 of the calendar year in which that fiscal year ended. A center whose designation letter is dated on or after October 1 files by December 29 of the following calendar year.

Does every NCE need an Attachment 1?

Only those with active EB-5 investors in the reporting period, the instructions say. If the last investor in an NCE filed Form I-829 in the fiscal year being reported, Attachment 1 is completed for that NCE. If that happened in an earlier fiscal year, it is not needed.

Can Form I-956G be filed online?

The I-956G page lists only mailing addresses: one for U.S. Postal Service deliveries and one for FedEx, UPS and DHL.

What happens if a statement is late or incomplete?

The instructions say USCIS may reject the form or ask for an amendment or supplement, and may impose sanctions such as fines, suspension, a permanent bar or termination of the regional center's designation.

What is the Form I-956G filing fee?

USCIS fees change, so this page does not list one. The I-956G page points to the USCIS Fee Schedule, and the instructions point to Form G-1055.
