Form I-829: Petition by Investor to Remove Conditions on Permanent Resident Status

Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status, is for immigrant investors who obtained conditional permanent resident status based on investment in a new commercial enterprise. The instructions say it asks USCIS to remove the conditions on the investor's status and on the status of certain dependents.

The instructions say the petition is submitted within the 90-day period immediately before the second anniversary of obtaining conditional permanent resident status. The USCIS page says the expiration date on the Green Card is also that second anniversary.

The instructions say that once USCIS accepts the petition, conditional permanent resident status is automatically extended for the period shown on the filing receipt, which is carried with the Permanent Resident Card. The current edition on the USCIS page is 01/20/25.

What's on Form I-829

Part 1: Basis for petition

Whether the investment is associated with a regional center, the regional center's name and ID number, the name and ID number of the new commercial enterprise (NCE), and one box from Items 4 to 6 for the petition type.

Part 2: Information about you

Name, A-Number, USCIS online account number, Social Security number, birth details, date of admission as a conditional permanent resident, the Form I-526 receipt number, addresses and criminal history questions.

Parts 3 and 4: Spouse and children

Details of a current or former conditional permanent resident spouse and of all children, including stepchildren and adopted children of any age, and whether each lives with the petitioner and is applying with them.

Part 5: Biographic information

Ethnicity, race, height, weight, eye and hair color. The instructions say giving this information may reduce the time spent at the biometrics appointment.

Parts 6 to 8: Regional center, NCE, JCE and jobs

Regional center designation details, the NCE address, NAICS codes, IRS tax ID and investment dates and amounts, the job creating entity (JCE), direct and indirect job counts, troubled business questions and changes to the business plan.

Parts 9 to 12: Signatures and extra space

The petitioner's contact information, certification and signature, the interpreter and preparer sections, and Part 12 for additional information.

How to fill out Form I-829

  1. 1

    Find the 90-day filing window

The USCIS page points to its When to File Your Petition to Remove Conditions page to find the first day of the window, and says a petition filed before that date may be rejected.

  2. 2

Complete Part 1 and pick one petition type

The instructions say the NCE name in Item 3.a. is a required field. Select only one box from Items 4 to 6 for the basis of the petition.

  3. 3

Fill the fields USCIS checks first

The USCIS page lists fields that lead to rejection when missing: the Part 1 basis, and in Part 2 the family name, A-Number, date of birth, date of admission and mailing address. Spouse and child dates of birth are needed when they apply with you.

  4. 4

List all children in Part 4

The instructions say to give information about all children, regardless of age. More than four children go in Part 12 with the same information.

  5. 5

Write N/A or None and use Part 12

Type or print in black ink. Write N/A where a question does not apply and None for a zero. Extra answers go in Part 12 with your name, A-Number, page, part and item number, signed and dated.

  6. 6

    Sign Part 9

A stamped or typewritten name is not accepted, and the USCIS page says an unsigned form is rejected. A parent or legal guardian may sign for a petitioner under 14. This page lets you fill the form online free, then print it for signature.

Where to file, timing, evidence and fees

Where to file

The USCIS page lists the USCIS Dallas Lockbox, with a P.O. Box address for U.S. Postal Service mail and a street address in Lewisville, Texas for FedEx, UPS and DHL. The instructions say a United States address is needed to file.

When to file

The USCIS page says the petition is filed during the 90-day period immediately before conditional residence expires. A late petition may be filed with a written explanation of good cause and extenuating circumstances, which USCIS may excuse in its discretion.

Fee

The fee is on the USCIS Fee Schedule page and in Form G-1055, which can change. Check it on the day you file.

Evidence of conditional status

A copy of the front and back of the petitioner's Permanent Resident Card, plus the cards of a spouse or former spouse and each child applying together.

Investment and job creation evidence

The instructions list evidence that the capital was invested and sustained through conditional residence, and that the investment created or can be expected to create 10 full-time jobs, such as audited financial statements, bank statements, tax returns, payroll records and copies of Form I-9.

Criminal history and translations

The instructions list court and arrest records to send for any arrest, charge or conviction since becoming a conditional permanent resident. Foreign-language documents need a full English translation with the translator's certification.

Who files Form I-829?

  • Immigrant investors

The instructions say the form is for a person granted conditional permanent resident status as an investor. In Part 1 the investor selects Item 4, conditional permanent resident based on investment in a commercial enterprise.

  • Spouse and children filing with the investor

The investor may include a conditional permanent resident spouse or former spouse and children in the petition. The instructions say a dependent not included files a separate Form I-829 as an individual petitioner.

  • Former spouses and children who turned 21 or married

The instructions say these dependents may still be included in the investor's petition or may file a separate one. A separate petitioner attaches a copy of the investor's Form I-797, Notice of Action, for the investor's I-829.

  • Surviving spouse or child of an investor

If the investor spouse or parent has died, the instructions say the spouse or child may use this form, selecting Part 1, Item 6. The surviving spouse and children may be included together on one petition.
