Part 1: Petition type
Whether this is an initial petition or an amendment, the earlier receipt number, and the reason: termination of the regional center, or debarment of the NCE or JCE.
I-526E
Immigrant Petition by Regional Center Investor
Form I-526E, Immigrant Petition by Regional Center Investor, is the form an investor pooling their investment with one or more qualified immigrants in the Regional Center Program uses to petition USCIS for status as an immigrant under section 203(b)(5)(E) of the Immigration and Nationality Act (INA), the EB-5 regional center category.
The instructions say an investor may file it for themselves after investing, or while actively in the process of investing, the required amount in a new commercial enterprise (NCE) in a USCIS-designated regional center that will create full-time jobs for at least 10 qualifying employees. The required amount is set by statute.
The USCIS page says a regional center investor may also use Form I-526E to report amendments needed to keep eligibility if the regional center, NCE or job-creating entity is terminated or debarred from the program. It also says USCIS rejects any Form I-526 that shows the investment is associated with a regional center.

Whether this is an initial petition or an amendment, the earlier receipt number, and the reason: termination of the regional center, or debarment of the NCE or JCE.
Your names, birth details, citizenship, addresses for the past five years, 20 years of employment history, entry, passport and nonimmigrant status details, then each family member and whether they will adjust status or apply for a visa abroad.

How initial evidence is sent, the receipt numbers for the regional center's Form I-956F and its approved regional center application, the NCE Identification Number (NCEID), and whether the project is in a rural, high unemployment or high employment area or is an infrastructure project.
Dates and amounts invested, the make-up of the investment, administrative costs, confirmation that the regional center disclosed all fees and promoter compensation, net worth, sources of capital, gifts or loans, and any third party who moved funds.
Immigrant visa abroad or adjustment of status, other forms filed together and immigration proceedings, then 13 Yes or No bona fides questions on fraud, securities orders and other conduct, and 3 questions on foreign government involvement.
The petitioner's statement, contact details, declaration and signature, the interpreter and preparer sections, and additional information space.
For an amendment, give the earlier receipt number and each reason that applies. The instructions say to describe any new associations or investments in Part 12.
Part 4 asks for the Form I-956F receipt number, the regional center application receipt number and the NCEID. The instructions say USCIS assigns the NCEID with the I-956F receipt notice and petitioners can get it from the regional center.
Select one box at the top of Part 4: evidence sent with the petition, or sent through a myUSCIS account. The instructions say the second option comes with instructions on the receipt notice.
The instructions say to answer Yes to any question that applies, even if the record was sealed or cleared, and wherever in the world it happened, and to explain each Yes in Part 12 with documents showing the outcome.
Type or print in black ink. Write N/A where a question does not apply and None for a zero. Extra answers go in Part 12 with your name, A-Number, and the page, part and item number.
A stamped or typewritten name is not accepted. The instructions say a photocopy, fax or scan of the original handwritten signature is valid for filing. This page lets you fill the form online free, then print it for signature.
You get the real form, filled in a browser tab, with nothing standing between you and the finished PDF.
The USCIS page points to its Direct Filing Addresses for Form I-526 and Form I-526E page, and says petitions sent to the wrong address may face processing delays.
The fee is on the USCIS Fee Schedule page, and the instructions point to Form G-1055. Fees can change, so check it on the day you file.
The USCIS page says that since Sept. 1, 2022, it does not accept one combined payment for Form I-526E filed with Form I-485, Form I-131 or Form I-765. It rejects forms sent with a single combined payment and returns the fee.
A copy of the regional center's Form I-956F receipt notice, proof of the investment such as bank statements, proof the capital and any fees were lawfully obtained, including tax returns from the last seven years, and a copy of government ID.
The instructions say capital does not include assets acquired by unlawful means, capital exchanged for a note, bond or other debt with the NCE, capital with a guaranteed rate of return, or capital with a contractual right to repayment.
The instructions say Form I-485 may be filed with or after Form I-526E if approval would make an immigrant visa immediately available, and point to the Visa Bulletin and the USCIS website to check.

The instructions say you may file for yourself if you have invested, or are actively in the process of investing, the required amount in an NCE in a USCIS-designated regional center that will create full-time employment for at least 10 qualifying employees.
Part 1 lets you file an amendment when your regional center is terminated, or your NCE or job-creating entity (JCE) is debarred. The instructions say an amendment completes every part with the new regional center, NCE, JCE or investment details.
The instructions say an investor not pooling their investment with other EB-5 investors files Form I-526, Immigrant Petition by Standalone Investor.
The instructions say the regional center has to have submitted Form I-956F, Application for Approval of an Investment in a Commercial Enterprise, before an investor can file, and that USCIS may reject the petition if no I-956F receipt notice has been issued yet.
The investor signs. The instructions say a parent or legal guardian may sign for a petitioner under 14, and a legal guardian may sign for a mentally incompetent person.

The USCIS page says petitions under INA 203(b)(5)(E) go on Form I-526E, and that USCIS rejects any Form I-526 that shows the investment is associated with a regional center.
The instructions say the NCE may associate with another designated regional center or you may make a qualifying investment in another NCE, and you report it by filing Form I-526E as an amendment.
The instructions say USCIS assigns the NCE Identification Number when it issues the receipt notice for the regional center's Form I-956F, and petitioners can get it from the regional center.
No. The USCIS page says a separate fee payment is needed for each form, and forms sent with a single combined payment are rejected.
USCIS fees change, so this page does not list one. The I-526E page points to the USCIS Fee Schedule, and the instructions point to Form G-1055.
