Form I-956: Application for Regional Center Designation

Form I-956, Application for Regional Center Designation, is used to request USCIS designation as a regional center under Immigration and Nationality Act (INA) section 203(b)(5)(E), or to request an amendment to an approved regional center.

The instructions describe a regional center as an entity that will pool investments and promote economic growth, including prospective job creation and increased domestic capital investment, in a particular geographic area.

The instructions list three kinds of change that call for an amendment: the regional center's name; its ownership, organizational structure or administration, including a sale or arrangements that bring in people not previously subject to INA 203(b)(5)(H); and its geographic area. Each person involved with the regional center also completes Form I-956H, Bona Fides of Persons Involved with Regional Center Program.

Select initial application or amendment. For an amendment, enter the regional center identification number and select every amendment type that applies.

Where to file, evidence and fees

Where to file

The USCIS page lists a P.O. Box in Dallas, TX for U.S. Postal Service mail and a Lewisville, TX address for FedEx, UPS and DHL deliveries, both marked Attn: I-956. The instructions say a United States address is needed to file.

Fee

The fee is on the USCIS Fee Schedule page (Form G-1055), which can change. Check it on the day you file.

Economic impact evidence

The instructions say the proposal includes reasonable predictions, supported by economically and statistically valid and transparent forecasting tools, on the pooled investment, the enterprises, the jobs created directly or indirectly and other economic effects.

Policy documents

A written policy document may describe the monitoring of new commercial enterprises and job-creating entities for compliance with immigration, criminal and securities laws, and the entity's EB-5 program compliance.

Address changes

The instructions say the regional center notifies USCIS of a change to its mailing address within 30 days, by email to the EB-5 Program mailbox, and not through the USCIS Lockbox.

Decision

The approval notice describes the regional center's responsibilities, the evidence for associated investor petitions and the reporting and oversight requirements. A denial notice explains the reasons and the right to appeal to the Administrative Appeals Office.

Who files Form I-956?

  • Entities seeking regional center designation

The regional center entity is the legal entity seeking designation. Part 2 asks whether it is a government entity, corporation, partnership, limited liability company or another type of entity.

  • Approved regional centers filing an amendment

An approved regional center files an amendment for a change of name, organizational structure, ownership, administration or geographic area, and gives its regional center identification number on each page.

  • Timing for structural changes

The instructions say an amendment for significant changes to structure, ownership or administration is filed not later than 120 days before the change is implemented. With exigent circumstances, notice goes to USCIS within five business days after the change.

  • Qualified certifier

Part 8 is completed by a person in a position of substantive authority, such as a principal executive or financial officer, with knowledge of the entity's compliance policies under INA 203(b)(5).

  • Authorized individual

Part 9 is signed by the authorized individual for the regional center. A stamped or typewritten name is not accepted, and the instructions say USCIS rejects an unsigned application.
