Form I-212: Permission to Reapply for Admission After Deportation or Removal

Form I-212, Application for Permission to Reapply for Admission into the United States After Deportation or Removal, is how a person who is inadmissible under INA section 212(a)(9)(A) or (C) asks for consent to reapply for admission so they can lawfully return to the United States. USCIS says consent to reapply is also called "permission to reapply."

The instructions say it is very important not to return to the United States before filing the application and before the Department of Homeland Security (DHS) has approved it. They list possible consequences of returning without consent when it is needed, including reinstatement of a removal order, prosecution under INA section 276 and a permanent bar under INA section 212(a)(9)(C).

Depending on the case, the application is filed with USCIS, with U.S. Customs and Border Protection (CBP), or as an immigration court directs. The instructions also say any departure from the United States may make a person inadmissible under these sections, and that travel with an Advance Parole Document counts as a departure.

What's on Form I-212

Part 1: Information about you

A-Number, full name, other names, mailing and physical address, Social Security number, USCIS online account number, sex, birth details and citizenship, plus whether the request goes with a visa application, an adjustment of status application or a Form I-601.

Part 2: Reasons you are filing

Four sections: removal as an arriving alien, removal as a deportable alien, entry after more than one year of unlawful presence, and entry after removal, each with dates and places of removal, departure and entry.

Part 3: Reasons for your request

The immigration status sought, why you want to reenter the United States, and any U.S. citizen or permanent resident family members with close ties to the country.

Parts 4 and 5: Biographic and CBP information

Ethnicity, race, height, weight, eye and hair color, then, for CBP filings only, five years of addresses and employment, parents and marital history. The instructions say Form G-325A is no longer needed with this application.

Parts 6 to 9: Signatures and extra space

The applicant's contact information, certification and signature, the interpreter and preparer sections, and Part 9 for additional information.

How to fill out Form I-212

  1. 1

    Find the ground that applies

The instructions say to review the official documents received during proceedings, which should show the section of law behind the exclusion, deportation or removal.

  2. 2

Complete the required fields in Part 1

The USCIS page says the form is rejected if the family name or mailing address in Part 1 is missing. Type or print in black ink, and write N/A where a question does not apply and None for a zero.

  3. 3

Fill in only the Part 2 sections that match

Give the date and place of each removal, departure, entry or attempted reentry. For the unlawful presence and entry after removal sections, the instructions ask for evidence of 10 years outside the United States since the last departure.

  4. 4

    Gather the evidence

The instructions list copies of all documents from the deportation or removal proceedings and proof of the relationship to any relative listed in Part 3. CBP filings add proof of citizenship and police records, which the instructions say are valid for 15 months.

  5. 5

    Explain the favorable factors

The instructions say approval is discretionary. Favorable factors include close family ties, hardship, rehabilitation and length of lawful presence, and claims in affidavits should be backed by evidence or an explanation of why it cannot be obtained.

  6. 6

    Sign Part 6 yourself

A stamped or typewritten name is not accepted, and a parent or legal guardian may sign for an applicant under 14. This page lets you fill the form online free, then print it for your signature.

Where to file, timing, evidence and fees

Filing with USCIS by mail

The USCIS page says the filing location changed on Oct. 7, 2026, and points to its Direct Filing Addresses for Form I-212 page, where the address depends on the reason for filing. Forms postmarked on or before Nov. 9, 2026, and sent to a prior location are accepted.

Filing with CBP

The USCIS page says CBP applicants can file through e-SAFE, and that manual filing stays available in person at CBP designated ports of entry. It points to the CBP website for people seeking admission without a nonimmigrant visa and for nonimmigrant visa applicants at a consulate other than K, T, U or V.

Filing while in removal proceedings

The USCIS page says to follow the special filing instructions the immigration court gave, and that USCIS only adjudicates applications correctly filed with USCIS, not those that belong with CBP or EOIR.

Fee

The fee is on the USCIS Fee Schedule page, and the instructions point to Form G-1055. Fees can change, so check it on the day you file.

E-Notification

For an email or text message when a USCIS lockbox accepts the form, the USCIS page says to complete Form G-1145 and clip it to the first page.

Approval and validity

The instructions say an approval is valid indefinitely unless revoked, and that a new inadmissibility under 212(a)(9)(A) or (C) after approval needs a new consent to reapply.

Who files Form I-212?

  • Inadmissible under INA 212(a)(9)(A)

People who were removed, or left on their own after an order of removal, and seek admission before the waiting period ends: 5 years after one removal as an arriving alien, 10 years after one other removal, 20 years after more than one removal, or at any time after an aggravated felony conviction.

  • Inadmissible under INA 212(a)(9)(C)

People who entered or tried to enter without being admitted or paroled after more than one year of unlawful presence in total, or after a removal order. The instructions say this application cannot be filed while in the United States or before 10 years outside the country since the last departure.

  • Applicants filing with CBP

The instructions say CBP has jurisdiction when a person seeks admission as a nonimmigrant at a port of entry without needing a nonimmigrant visa. The USCIS page says these can be filed electronically through CBP e-SAFE or in person at CBP designated ports of entry.

  • People who may not need it

The instructions list cases such as an expired inadmissibility period, a withdrawn application for admission at the border, a refusal of entry without formal removal, a voluntary departure followed on time, Registry applicants and TPS applicants.

  • A waiver instead of consent

Some applicants use Form I-601, Form I-690 or Form I-192 instead, for example NACARA or HRIFA adjustment applicants, T and U applicants and certain VAWA self-petitioners. The instructions note that a person inadmissible under both (9)(A) and (9)(C) should file Form I-212 and Form I-601.

Questions about Form I-212

Is consent to reapply the same as permission to reapply?

Yes. The USCIS page and the instructions say consent to reapply is also called permission to reapply, and Form I-212 is the application for it.

Can I file Form I-212 while still in the United States?

In one case. The instructions say a person ordered removed who has not left and will apply for an immigrant visa abroad may file before leaving, with any approval conditional until departure. This covers 212(a)(9)(A) only; under 212(a)(9)(C) it cannot be filed from inside the country.

Does a visa protect me if I return without consent?

The instructions say returning with a visa may not protect a person from the consequences if consent to reapply was required but not obtained.

How long is an approved Form I-212 valid?

The instructions say it is valid indefinitely unless revoked by the agency that approved it. Consent granted for nonimmigrant purposes is also valid for future immigrant or nonimmigrant purposes.

Do I need to send Form G-325A with Form I-212?

No. The instructions say Form G-325A is no longer required with this application, because all the data is now collected on Form I-212.

What is the Form I-212 filing fee?

USCIS fees change, so this page does not list one. The I-212 page points to the USCIS Fee Schedule, and the instructions point to Form G-1055.
