Standard Form 312 (SF 312): Classified Information Nondisclosure Agreement

Standard Form 312 (SF 312), the Classified Information Nondisclosure Agreement, is an agreement between a named individual and the United States. Its footer says it is prescribed by ODNI under 32 CFR PART 2001.80 and E.O. 13526, edition REV. 12/2023, and that the previous edition is not usable. GSA hosts a copy in its forms library.

The signer accepts the obligations in the agreement in consideration of being granted access to classified information. The form has 12 numbered paragraphs on security indoctrination, when classified information may be disclosed, what a breach may lead to, returning classified materials and whistleblower protections. They are followed by signature, organization, witness and acceptance blocks and a Security Debriefing Acknowledgement.

What's on SF 312

Paragraphs 1 to 3: access and disclosure

What counts as classified information, an acknowledgment of a security indoctrination, and an agreement never to divulge classified information unless the recipient is officially verified as authorized or prior written notice of authorization is given.

Paragraphs 4 to 6: breach and remedies

A breach may lead to loss of clearances, removal from positions of special confidence and trust, or termination of employment. The form cites sections 641, 793, 794, 798, 952 and 1924, Title 18, United States Code, assigns royalties to the Government and notes court orders.

Paragraphs 7 to 9: property and duration

Classified information remains the property of, or under the control of, the United States Government. Classified materials are returned on demand or when the relationship ends, the obligations continue at all times thereafter, and each provision is severable.

Paragraphs 10 to 12: protections and acknowledgment

Statements that the agreement does not supersede or alter rights on communications to Congress, reports to an Inspector General or the Office of Special Counsel, or whistleblower protection, then a statement that the signer read the agreement and had questions answered.

Signature, organization, witness and acceptance

Signature, date and Social Security Number, the organization block, the witness block and the acceptance block, each with a name and address typed or printed.

Security Debriefing Acknowledgement

A reaffirmation that classified information has been returned and will not be passed to unauthorized persons, that attempts to solicit it will be promptly reported to the Federal Bureau of Investigation, and whether a security debriefing was received.

The agreement is printed as 12 numbered paragraphs, then the signature and debriefing blocks.
