Standard Form 2802 (SF 2802): Application for Refund of Retirement Deductions (CSRS)

Standard Form 2802 (SF 2802), Application for Refund of Retirement Deductions, Civil Service Retirement System, is a U.S. Office of Personnel Management (OPM) form, Revised September 2013, under the CSRS/FERS Handbook for Personnel and Payroll Offices, with OMB Number 3206-0128. GSA hosts a copy in its forms library. It is the application for a refund of the retirement deductions withheld from salary under the Civil Service Retirement System (CSRS).

The package holds the two-page application, a page for former spouses with the rollover election and financial institution certifications, the Notice to Applicant, a Special Tax Notice Regarding Rollovers, and SF 2802A, Current/Former Spouse's Notification of Application for Refund of Retirement Deductions.

The form says anyone now or ever covered by the Federal Employees Retirement System cannot use it, even for a refund of Civil Service Retirement deductions, and uses Standard Form 3106 instead. You can fill it out free in your browser on this page and download the result without an account.

Questions about Form SF2802

Who issues SF 2802?

The form is printed as a U.S. Office of Personnel Management form, OMB Number 3206-0128, Revised September 2013, under the CSRS/FERS Handbook for Personnel and Payroll Offices. GSA hosts a copy in its forms library.

Can SF 2802 be used by someone covered by FERS?

The form says anyone now or ever covered by the Federal Employees Retirement System cannot use it, even to request a refund of Civil Service Retirement deductions, and uses Standard Form 3106 instead.

What does the form say about annuity rights?

The Notice to Applicant says someone with more than five years of service may be entitled to annuity rights that are forfeited by receiving the refund, unless later reemployed under CSRS or FERS. It also says payment of the refund ends any eligibility a former spouse may have to coverage under the Federal Employees Health Benefits Program.

Why does SF 2802 ask about spouses?

SF 2802A says the Civil Service Retirement law allows a refund only if the applicant notifies any current spouse and any former spouse divorced on or after May 7, 1985. It says a former spouse need not be notified if the marriage lasted less than 9 months in total or the applicant has less than 18 months of creditable civilian service.

What if a spouse cannot be found?

SF 2802A says OPM may waive the notification if the applicant submits a determination by a court or administrative agency that the person is missing, or notarized statements from the applicant and two other persons, one not related to the applicant, saying the whereabouts are unknown and detailing efforts to locate the person.

Can the refund be rolled over?

The rollover election on page 3 applies to a refund of $200 or more. The form says the Thrift Savings Plan accepts only the interest portion, using form TSP-60, and that when less than 100% of the refund is rolled over, the total rolled over to any one organization is at least $500.

How long does SF 2802 take to fill out?

OPM estimates an average 45 minutes, including time for reviewing instructions, getting the needed data and reviewing the completed form.
