Form I-941: Application for Entrepreneur Parole

Form I-941, Application for Entrepreneur Parole, is the form an entrepreneur uses under the International Entrepreneur Rule (IER). The USCIS page says DHS may grant a period of authorized stay, technically called parole, on a case-by-case basis to entrepreneurs who show their stay would provide a significant public benefit through their business venture and that they merit a favorable exercise of discretion.

The instructions list three uses: an initial request for parole based on significant public benefit, a subsequent request for an additional period (re-parole), and an amended application to notify USCIS of a material change.

The instructions say a paroled person has not been admitted to the United States and remains an applicant for admission. For someone outside the United States, the final decision to parole is made by U.S. Customs and Border Protection (CBP) at a U.S. Port of Entry.

How to fill out Form I-941

  1. 1

Use the current edition and write clearly

Type or print in black ink. The USCIS page says all pages come from the same form edition with the edition date and page numbers visible, or USCIS may reject the form.

  2. 2

Select the request type in Part 1

Choose initial parole, re-parole or amended application. For re-parole or an amendment, enter the receipt number of the current Form I-941 approval in Item Number 2.

  3. 3

    Answer every question

Write N/A where a question does not apply and None for a zero. The instructions say an Online Account Number only exists if you filed a form with a receipt number starting IOE.

  4. 4

Complete the section of Part 5 that fits

Initial parole uses Items 9 to 15, re-parole Items 16 to 29, and an amended application Items 30 to 32. List every other owner of the start-up entity.

  5. 5

    Write the explanatory statement

Item 9 (initial) or Item 27 (re-parole) asks for a detailed statement on your role in the entity and how your involvement will advance its growth. It can go in Part 10 or on a separate signed sheet.

  6. 6

    Sign Part 7

A stamped or typewritten name is not accepted, and DHS rejects an unsigned Form I-941. This page lets you fill the form online free, then print it for your signature.

Where to file, evidence and fees

Where to file

The USCIS page lists a P.O. Box in Dallas, TX for U.S. Postal Service mail and a Lewisville, TX address for FedEx, UPS and DHL deliveries, both marked Attn: IER. The instructions say the form is not properly filed until a USCIS Lockbox facility accepts it.

Fee

The fee is on the USCIS Fee Schedule page (Form G-1055), which can change. Check it on the day you file. The instructions say DHS rejects a Form I-941 sent without the correct filing fees.

Investment, grant or award evidence

The instructions set minimum qualified investment and government award amounts received within 18 months before filing, describe who counts as a qualified investor, and allow other reliable and compelling evidence when the entity partially meets them.

Role, ownership and identity evidence

Examples in the instructions include a passport or other photo identity document, letters, press coverage, accelerator participation, degrees, patents, organizational documents, equity ledgers and capitalization tables.

Parole length

The instructions say entrepreneur parole totals no more than 5 years: an initial period of up to 30 months and one re-parole period of up to 30 months.

Biometrics and travel

USCIS may require an interview or biometrics. The instructions warn that an Advance Parole Document does not entitle a person to be paroled, and that DHS may revoke or terminate parole at any time.

Who files Form I-941?

  • Entrepreneurs seeking initial parole

The instructions say the evidence should show a central and active role in a U.S. start-up entity, at least a 10% ownership stake, and an entity that was recently formed and has substantial potential for rapid growth and job creation.

  • Entrepreneur parolees seeking re-parole

The instructions say to file before the current parole period expires but no earlier than 90 days before it ends. Re-parole evidence covers a continued central role, at least a 5% ownership stake and the entity's funding, jobs or revenue.

  • Parolees reporting a material change

A person granted entrepreneur parole may submit the form with the fee as an amended application. The instructions say failure to timely report a material change may result in termination of parole.

  • One entrepreneur per application

The instructions say only one entrepreneur may request parole per application, and additional entrepreneurs with the same start-up entity file separate applications. Part 4 lists those other entrepreneurs.

  • Spouse and children use Form I-131

The instructions say requests for parole for the entrepreneur's spouse and children are filed with Form I-131, Application for Travel Document, with evidence of the family relationship.
