Standard Form 1416 (SF 1416): Payment Bond for Other than Construction Contracts

Standard Form 1416 (SF 1416), Payment Bond for Other than Construction Contracts, is a three-page bond form with its instructions on page 3. The footer says it is prescribed by GSA under FAR (48 CFR) 53.228(m), and GSA hosts it in its forms library. The edition printed on the form is STANDARD FORM 1416 (REV. 10/2023), with OMB Control Number 9000-0001, and the footer says the previous edition is not usable.

The instructions say the form is authorized for use when payment bonds are required under FAR (48 CFR) 28.103-3, i.e., payment bonds for other than construction contracts, and that any deviation from the form will require the written approval of the Administrator of General Services. The face names the principal, the surety or sureties, the penal sum and the contract, then sets out the obligation and the conditions under which it is void or stays in force.

Page 2 holds signature blocks for the principal, individual sureties and corporate sureties. You can fill it out free in your browser on this page and download the result without an account.

What's on SF 1416

Face: principal, sureties and penal sum

The principal's legal name and business address, date bond executed, type of organization and state of incorporation, the sureties' names and business addresses, the penal sum by millions, thousands, hundreds and cents, and the contract date and number.

The obligation

The principal and sureties are bound to the United States in the penal sum, jointly and severally. The form says each surety binds itself for the sum shown opposite its name, and if no limit of liability is indicated, the limit is the full penal sum.

Conditions (a) and (b)

The form says the obligation is void if the principal promptly makes payment to all persons (claimants) furnishing labor, material or both under the contract, and remains in full force if it does not.

Limits on a claimant's suit

The form lists three: written notice to the principal within ninety (90) days for some claimants, no suit after one (1) year following the last work or materials, and only in the United States District court for the district where the contract was performed.

Page 2: signatures

Signature blocks with seals for up to four principal signers, two individual sureties, and corporate Surety A and Surety B, each with name and address, state of incorporation and liability limit.

Page 3: instructions

Five numbered instructions on when the form is used, naming the principal, corporate and individual sureties, seals, and typing each signer's name and title, followed by the Paperwork Reduction Act statement.
