WT 2B: Report of Application and/or Order Authorizing Interception (State/County/Local)

WT 2B, Report of Application and/or Order Authorizing Interception of Communications (State/County/Local), is the non-federal version of the WT-2 wiretap report to the Administrative Office of the United States Courts. The U.S. Courts list it under Other Forms. It is not a form members of the public file: the guidance on the U.S. Courts page says 18 U.S.C. 2519 requires both judges and prosecutors to report on Title III wiretap applications to the Administrative Office on an annual basis.

The form has two parts. Part 1 (Judge's Report) covers the state and court, the officials and agency involved, the most serious offense, the type of order, the duration and extensions, the type of intercept and the judge's endorsement. Part 2 (Prosecutor's Report) covers installation, the intercepts, encryption, costs, results and comments. The printed form is marked Rev. 07/2025. The U.S. Courts page lists it as effective on October 1, 2015 and updated on January 6, 2025, and names WT 2A, the Federal version, as a related link.

This page explains the form in plain words and is not legal advice. The officials completing it can fill it out free in the browser on this page and download the result without an account.

How to fill out WT 2B

  1. 1

Check that the order is reportable

The guidance lists situations where a WT-2 Part 1 is not submitted, such as orders issued with the consent of a principal party, when only a body microphone is used, or when the order is related to a sealed terrorism case.

  2. 2

Complete Part 1 for the judge

Select the State first, then the court jurisdiction. The guidance says the No. of Days should typically be 30 days and cannot exceed that for the original request or any single request for extension.

  3. 3

Validate, save and send Part 1

The form says to click Validate Part 1, save a PDF with a unique file name, email it to [email protected], give an electronic copy to the official making the application, and keep a copy for the judge's files.

  4. 4

Complete Part 2 for the prosecutor

Fill in installation, intercepts, costs and results. The form says future results should be reported on the WT-3 Supplementary Report.

  5. 5

    Leave out identifying details

Section 13 says not to include the target's name, address, phone numbers, name of gangs, or other sensitive information.

  6. 6

    Validate and send Part 2

The form says to validate Part 2, save a PDF with a unique file name, email it to [email protected], and keep a copy for your files.

Due dates, routing and privacy

Part 1 due date

The form says Part 1 is to be reported by January 31 for denied applications and for approved applications for orders that expired during the preceding year, pursuant to 18 U.S.C. § 2519(1).

Part 2 due date

The form says Part 2 is to be reported by March 31 for denied applications and for approved applications for orders that expired during the preceding year, pursuant to 18 U.S.C 2519(2).

Where it goes

The form and guidance say both parts are emailed as PDF files to [email protected], one uniquely named PDF per report, not combined into a single PDF.

No fax or mail

The guidance says the Administrative Office does not accept WT-2 forms by fax or regular mail except under rare circumstances when a court cannot submit electronically.

Privacy

The guidance says not to include the name, telephone number, address, or any potentially identifying information about any subject of the wiretap anywhere on the report.

Fees

The form and its page do not print a fee.

Who completes WT 2B?

  • The judge who authorized or denied the application

The guidance says the authorizing or denying judge is responsible for reporting all WT-2 Part 1 forms to the Administrative Office, and Section 8A needs the judge's endorsement regardless of who prepares Part 1.

  • Court staff preparing Part 1

The guidance says a judge can authorize court staff to complete Part 1 on the judge's behalf. Section 8B records the name, telephone number and title of the person who actually prepared it.

  • State, county and local prosecutors

The guidance says prosecutors are responsible for reporting both Part 1 and Part 2 data. The form says judges stop after Part 1, and prosecutors and law enforcement agencies continue to Part 2.

  • The law enforcement agency

Section 3B asks for the agency conducting the wiretap, with the examples FBI, DEA and Sheriff, an agency reference number and a contact person.

  • The Administrative Office

The Administrative Office of the U.S. Courts receives the reports. The guidance says it is not authorized to collect identifying information about any subject of the wiretap.

WT 2B is a reporting form for state and local judges, court staff and prosecutors, not a form for the public. The form and its guidance name these roles.

The form says Part 1 is to be reported by January 31 and Part 2 by March 31, for denied applications and for approved applications for orders that expired during the preceding year.

Which wiretaps are not reported on WT 2B?

The guidance says a Part 1 is not submitted when an order is issued at the request or with the consent of a principal party, when a police officer or informant is a party, when only a body microphone is used, when a pen register is used alone, or when the order is related to a sealed terrorism case.

What if the court jurisdiction is not in the list?

How is WT 2B different from WT 2A?

WT 2B is the State/County/Local version, and the U.S. Courts page links WT 2A as the Federal version. WT 2B asks for the State and has no section for an authorizing official at the Department of Justice, and its Part 2 is emailed to the Administrative Office.
