CJA 19: Notice to Court-Appointed Counsel of Public Disclosure of Attorney Fee Information

CJA 19, Notice to Court-Appointed Counsel of Public Disclosure of Attorney Fee Information, is a one-page notice in the Criminal Justice Act (CJA) series from the U.S. Courts. The U.S. Courts list it under CJA Forms. The current version is Rev. 4/01, and the U.S. Courts page lists it as effective on April 1, 2001.

The notice is addressed to court-appointed counsel. It says the CJA, 18 U.S.C. § 3006A, was amended in 1998 to require that amounts paid to court-appointed attorneys be made publicly available upon the court's approval of the payments. That paragraph, § 3006A(d)(4), expired after two years and applies only to cases commenced between January 25, 1998, and January 24, 2000, but the notice says the corresponding guideline, paragraph 5.01 of the CJA Guidelines, continues as a matter of Judicial Conference policy. It then explains what the court makes public before or during trial, after trial and after appeal.

This page explains the notice in plain words and is not legal advice. You can open it free in your browser on this page and download it without an account.

What's in CJA 19

Opening paragraph

The 1998 amendment to the CJA, the expired paragraph § 3006A(d)(4), the guideline that continues as Judicial Conference policy, and the two kinds of disclosure: an unredacted voucher or a redacted one showing only the amounts approved.

A. Before or during the trial

After redacting any detailed information provided to justify the expenses, the court makes available only the amounts approved for payment. After trial, unredacted copies may be released depending on whether an appeal is pursued and on the part B.1 interests.

B.1 After trial, no appeal pending

An unredacted copy is made public unless the court finds a listed interest justifies limiting it: the 5th Amendment right against self-incrimination, the 6th Amendment right to effective counsel, attorney-client privilege, work product privilege, safety of any person, or another interest of justice.

B.2 After trial, appeal pending

The court makes available only the amounts approved for payment, as in part A, unless it finds that none of the part B.1 interests will be compromised.

C. After the appeal is completed

The court makes an unredacted copy of the payment voucher available to the public unless it determines that one or more of the part B.1 interests justify limiting disclosure to the amounts approved.

Death penalty note and closing notice

Interest (6) says that in death penalty cases where the alleged conduct took place on or after April 19, 1995, the amount of the fees is not a reason for limited disclosure. The closing paragraph covers the written request and the notice under Guideline 5.01.

How to read CJA 19

  1. 1

Find the stage of the case

The notice sorts disclosure by stage: before or during trial in part A, after trial in part B, and after the appeal in part C.

  2. 2

    Review the listed interests

Part B.1 lists the six interests the court may weigh when it limits disclosure to the amounts approved for payment.

  3. 3

    Note what a request contains

The notice says a written request to the court identifies the interests at risk and the arguments in support of providing protection.

  4. 4

Note when a request is made

The notice says to submit a request at or before the time a claim for payment is made, and that failure to do so could result in unredacted vouchers becoming public without further notice.

  5. 5

    Print or save it

The PDF has no fields to fill in and no signature lines, only a Print button.
