AO 247: Order Regarding Motion For Sentence Reduction Pursuant To 18 U.S.C. § 3582(C)(2)

AO 247, Order Regarding Motion for Sentence Reduction Pursuant to 18 U.S.C. § 3582(c)(2), is the order a United States District Court uses to rule on a motion to reduce a term of imprisonment that was based on a guideline sentencing range the United States Sentencing Commission has since lowered and made retroactive under 28 U.S.C. § 994(u). The U.S. Courts lists it under Criminal Forms, effective on March 1, 2019, and the edition printed on the form is Rev. 03/19.

The form has two pages. Page 1 is the order itself: who brought the motion, whether it is denied or granted, the reduced sentence, and the judge's signature. Page 2 holds the court's guideline range determination and the factors considered, and the form marks it Not for Public Disclosure.

It is a court document. The judge signs it, and the defendant, the Director of the Bureau of Prisons or the court is named on it as the source of the motion. This page explains the form in plain words and is not legal advice. You can fill it out free in your browser on this page and download the result without an account.

  • The defendant

The order is captioned United States of America v. the defendant, with the case number, USM number and defendant's attorney. One of the motion boxes is the defendant.

  • The Director of the Bureau of Prisons
