Form N-336: Request for a Hearing on a Decision in Naturalization Proceedings

Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA), is used to request a hearing before an immigration officer on a USCIS denial of Form N-400, Application for Naturalization.

The USCIS page says a hearing can be requested if the Form N-400 is denied after the eligibility interview and the applicant believes they can overcome the grounds for denial. It says to file within 30 calendar days of receiving the decision, or within 33 calendar days if USCIS mailed it, and that USCIS generally rejects a request that is not timely filed.

The page adds that if a late request meets the requirements for a motion to reopen or motion to reconsider, USCIS will reopen or reconsider the case and send a decision. The instructions say documents or briefs may be submitted with the form or at the hearing.

How to fill out Form N-336

  1. 1

Use edition 04/01/24 and black ink

Type or print legibly in black ink. The USCIS page says every page has to come from the same edition, with the edition date and page numbers visible, or USCIS may reject the form.

  2. 2

Complete the fields USCIS checks first

The page says USCIS rejects the form if the family name, date of birth or address is missing. The instructions say to put your A-Number at the top right of each page, or N/A if you have none.

  3. 3

Copy the details of the denial

The instructions say the N-400 receipt number is in the upper left corner of the receipt notice. Add the date of the denial notice in mm/dd/yyyy form and the USCIS office that issued it.

  4. 4

    Give your physical address

The instructions say to give where you now reside and not a PO Box unless it is your only address. VAWA beneficiaries may give a safe address. Outside the United States, repeat the city if there is no state and enter 00000 for a missing postal code.

  5. 5

Explain your reasons in Part 4

State why you are requesting a hearing on the denied Form N-400. Use Part 8 for more space, and write N/A where a question does not apply and None for a zero.

  6. 6

    Sign Part 5

A stamped or typewritten name is not accepted, and the page says USCIS rejects an unsigned form. This page lets you fill the form online free, then print it for signature.

Where to file, timing, evidence and fees

Filing options

The USCIS page says Form N-336 may be filed online through a USCIS online account or by mail. Mailed forms go to the USCIS Phoenix or Elgin Lockbox, depending on where you live, and the page lists which states and territories go where.

When to file

Within 30 calendar days of receiving the decision denying the Form N-400, or 33 calendar days if USCIS mailed it, the page says. It also says USCIS does not refund the fee if the request is rejected as not timely filed.

Fee

The fee is on the USCIS Fee Schedule page (Form G-1055), which can change. Check it on the day you file. The instructions say USCIS rejects a request without the correct fee unless it comes with Form I-912, Request for Fee Waiver.

Supporting documents

The instructions say additional documents or briefs may be submitted with the form or at the hearing. A foreign-language document needs a full English translation with the translator's certification.

E-Notification

To get an email or text message when a USCIS lockbox accepts the form, the page says to complete Form G-1145 and clip it to the first page of the form.

If USCIS rejects the form

The instructions say a rejected form and any fees are returned, with the reason, when a complete and valid mailing address is given, and the deficiency can be corrected and Form N-336 refiled.
