Form I-824: Application for Action on an Approved Application or Petition

Form I-824, Application for Action on an Approved Application or Petition, is used to request further action on a previously approved application or petition. The instructions say it goes to USCIS, or to U.S. Customs and Border Protection (CBP) for certain approvals CBP issued.

With USCIS, the form offers five requests: a duplicate approval notice, notice to a new U.S. Consulate or Port-of-Entry, notice to a consulate that a permanent resident's status was adjusted so a spouse or children may follow to join, sending an approved immigrant visa petition to the National Visa Center (NVC), and notice to the Department of State of naturalization.

The USCIS page says it will not process Form I-824 if the petition or application is still pending or has been denied. The instructions say Form I-824 cannot be used to check the status of a pending case, that it may be filed with the original application or petition under 8 CFR 103.9, and that each action needs a separate Form I-824.

How to fill out Form I-824

  1. 1

Confirm Form I-824 is the right form

The instructions list requests it does not cover, such as correcting an error on an approval notice or replacing a card. An EAD is replaced with Form I-765, Form I-94 with Form I-102, a Green Card with Form I-90 and a travel document with Form I-131.

  2. 2

Select one reason in Part 2

Choose only one box from 1.a. to 1.e. The instructions say a separate Form I-824 is filed for each action requested.

  3. 3

Enter the receipt number in Part 3

The USCIS page says the form is rejected if the Part 3 receipt number from Form I-797, Notice of Action, is missing, or if it is not signed.

  4. 4

List each family member for a 1.c. request

The instructions say Items 5.a. to 34 of Part 3 are completed for each family member who will follow to join. Extra entries go in Part 7.

  5. 5

    Write clearly and use N/A

Type or print in black ink. Write N/A where a question does not apply and None for a zero. The instructions say a U.S. citizen writes N/A for immigration status in Part 1, Item 4.

  6. 6

    Sign Part 4

The instructions say a stamped or typewritten name is not accepted, and a parent or legal guardian may sign for an applicant under 14. This page lets you fill the form online free, then print it for signature.

Where to file, evidence and fees

Where to file

The USCIS page says the filing location changed on Oct. 7, 2026. Mail filers check the Direct Filing Addresses for Form I-824 page, by agency. USCIS gives a grace period and accepts forms postmarked on or before Nov. 9, 2026 sent to a prior location.

Filing with CBP

The instructions say CBP filers file at the CBP-designated Port-of-Entry listed on www.cbp.gov, or mail to the CBP Admissibility Review Office at the address on that site.

Fee

The fee is on the USCIS Fee Schedule page, and the instructions point to Form G-1055. Fees can change, so check it on the day you file.

Evidence

The instructions ask for a copy, front and back, of Form I-797 for the approved case for requests 1.a. to 1.d., or a copy of Form N-550, Certificate of Naturalization, for request 1.e.

What a duplicate notice includes

The instructions say a duplicate approval notice is only a Form I-797. It does not include a copy of the approved application or petition, or a replacement EAD, Permanent Resident Card or travel document.

Follow-to-join limits

The instructions say the 1.c. notice is not available to someone admitted on an immigrant visa issued abroad, who can contact the NVC, or to refugees and asylees, who use Form I-730. Approval does not guarantee a visa.

Who files Form I-824?

  • The applicant or petitioner on the approved case

The instructions say the applicant or petitioner on the previously approved application or petition completes and signs the form to request a duplicate notice (1.a.) or a notice to a new consulate or Port-of-Entry (1.b.).

  • Permanent residents who adjusted status

The principal Form I-485 applicant requests 1.c. so a spouse or children may follow to join. The instructions say this applies to adjustment based on Form I-130, I-140 or I-360, or a diversity case number, approved by USCIS or an Immigration Judge.

  • Petitioners on immigrant visa petitions

The instructions say only the petitioner of the approved immigrant visa petition files for 1.d. (send it to the NVC) or 1.e. (notice of naturalization), giving the A-Number or the receipt number of that petition.

  • Companies and organizations

When the petitioner is a company or organization, the instructions say to give its name and IRS tax number in Part 1 and leave the personal name fields blank.

  • Filers with CBP

The instructions say Form I-824 is filed with CBP for a duplicate Form I-192 or Form I-212 approval notice that was lost, stolen or mutilated, or for a duplicate of an indefinite waiver issued before April 1, 1998.
