Form I-407: Record of Abandonment of Lawful Permanent Resident Status

Form I-407, Record of Abandonment of Lawful Permanent Resident Status, is how a lawful permanent resident (LPR) lets USCIS know they are voluntarily abandoning that status. USCIS says it will update its records to show the person is no longer an LPR.

The instructions describe it as a simple procedure to record the abandonment. It also makes sure the person is informed of the right to a hearing before an immigration judge and has knowingly, willingly and affirmatively waived that right.

The form itself says submission is voluntary and that U.S. law does not require anyone to complete, sign or submit it. It adds that a person who disagrees with a DHS claim that they abandoned LPR status may request a hearing before an immigration judge.

How to fill out Form I-407

  1. 1

Use the 09/25/24 edition and include all pages

Type or print in black ink. Write N/A where a question does not apply and None for a zero. The instructions say all pages are included when the form is submitted.

  2. 2

Write your A-Number with nine digits

Put your A-Number at the top right of each page. The instructions say to add zeros before a shorter number, so A1234567 is entered as A001234567.

  3. 3

Enter your name as it appears on your card

Item 3 uses the name exactly as printed on the Permanent Resident Card, even if it is misspelled or has changed since, or N/A without a card. Item 4 is your current legal name.

  4. 4

Mark the documents and where you are submitting

Select every document you surrendered. If the card is not returned, select why and complete the certification in Item 13. Then select one of Items 15 to 18 for where you are submitting.

  5. 5

Read the hearing rights and sign

The instructions list the rights at a hearing before an immigration judge that signing waives, and say the form is signed before DHS or DOS accepts it. This page lets you fill the form online free, then print it for signature.

Where to file, documents and fees

Mailing address

The USCIS page says to mail Form I-407 to its facility in Lee's Summit, MO, for USPS, FedEx, UPS and DHL deliveries: USCIS, Attn: I-407, 7 Product Way, Lee's Summit, MO 64002.

In person and at a port of entry

In very rare circumstances, the page says a USCIS international field office, or a U.S. embassy or consulate without one, may allow in-person submission when immediate proof is needed, most commonly to apply for an A or G visa. A CBP officer at a U.S. port of entry can also take it.

Fee

The USCIS page points to its Fee Schedule page, and the instructions point to Form G-1055. Fees can change, so check them on the day you file.

Documents to surrender

The page says to surrender only documents issued by USCIS, not documents such as a state-issued driver's license or a Social Security card. The instructions name Permanent Resident Cards, reentry permits and refugee travel documents.

IRS notice

The page says USCIS provides the filer's name and filing date to the Internal Revenue Service under Internal Revenue Code section 6039G(d)(3), and that there may be significant income tax consequences, such as an expatriation tax.

Email address

The form recommends an email address for anyone outside the United States, and the instructions say processing may be delayed without one if USCIS needs to make contact.

Who files Form I-407?

  • LPRs abroad or at a port of entry

The instructions say Form I-407 is used by lawful permanent residents who are outside the United States or at a port of entry and want to abandon their LPR status.

  • People recording an earlier abandonment

It may also be used by people admitted as nonimmigrants or paroled after abandoning a prior LPR status, to record that prior abandonment. Item 18 covers submitting from inside the United States for this reason.

  • Parents and guardians of minors

For an LPR 14 or younger, a parent, custodial parent or duly appointed legal guardian signs and consents, with evidence of the relationship or guardianship. The instructions say a parent's abandonment generally covers minor children in that parent's custody.

  • Guardians of incapacitated adults

For an incapacitated adult, the duly appointed legal guardian signs and consents, and submits an official letter of guardianship or other order from a government agency or court.

  • DHS and consular officers

The instructions say DHS officials and Department of State consular officers also use the form to record abandonment during an in-person interview or by correspondence. Part 4 is for government use only.
