Form 941 (sp): Spanish Version of the Employer's Quarterly Federal Tax Return

Form 941 (sp) is the Spanish version of Form 941, Employer's QUARTERLY Federal Tax Return. On the PDF it is titled "Formulario 941 para 2026: Declaración del Impuesto Federal TRIMESTRAL del Empleador," and the line labels are in Spanish. The English edition is Form 941.

The IRS About page says employers use Form 941 to report federal income, social security and Medicare taxes withheld from employees' paychecks, and to report the employer's share of social security and Medicare taxes. This edition covers the quarters of 2026: the employer checks one box for the quarter being reported.

The return is two pages in five parts, and page 2 ends with the signature. A third page holds Form 941-V, the payment voucher, with its own Spanish instructions. For the return itself, the form says to read the separate instructions first. The PDF can be filled out free in the browser on this page and downloaded without an account.

How to fill out Form 941 (sp)

  1. 1

    Identify the business and quarter

Enter the EIN, the legal business name (not the trade name), any trade name and the address. Check one box for the 2026 quarter being reported.

  2. 2

    Lines 1 to 3

Line 1 counts employees who received wages, tips or other pay for the pay period including March 12, June 12, September 12 or December 12. Lines 2 and 3 hold the wages and the federal income tax withheld.

  3. 3

    Lines 4 to 6

Check line 4 and go to line 6 if no wages or tips are subject to social security and Medicare tax. Otherwise multiply column 1 of lines 5a to 5d by the printed rates and add column 2 on line 5e.

  4. 4

    Lines 7 to 15

Enter adjustments for fractions of cents, sick pay, tips and group-term life insurance, the Form 8974 credit on line 11 and deposits on line 13. Line 14 is the balance due. Line 15a is an overpayment, applied to the next return or refunded to the account on lines 15c to 15e.

  5. 5

    Part 2

Check one box on line 16. A monthly schedule depositor enters the liability for each month and the quarter total, which the form says has to equal line 12. A semiweekly depositor completes and attaches Schedule B (Form 941).

  6. 6

    Sign the return

The form says both pages of Form 941 have to be completed and signed. Sign and date Part 5, print the name and title, and add the best daytime phone number.

Paying, depositing and where it goes

Where it goes

The voucher instructions say to send Form 941-V with the payment and Form 941 to the address in the Instructions for Form 941. An employer that pays by EFT files using the "without a payment" address there and does not send Form 941-V.

Paying with the return

The form says to pay with Form 941 only if line 12 for the current or prior quarter is under $2,500, there was no $100,000 next-day deposit obligation in the quarter and the amount is paid in full with a timely return, or as a monthly depositor under the accuracy of deposits rule.

Deposits by EFT

Otherwise the form says the payment is deposited by electronic funds transfer through EFTPS, IRS Direct Pay or the IRS business tax account, not with Form 941-V. It warns that paying with the return an amount that should have been deposited can bring a penalty.

Check or money order

Make it payable to "United States Treasury" and write the EIN, "Formulario 941" and the tax period, such as "1er trimestre de 2026", on it. The form says not to send cash and not to staple the voucher or payment to the return.

No EIN yet

The voucher instructions say an EIN can be requested online at www.irs.gov/EIN or by sending Form SS-4 by fax or mail. If one was requested but not received by the due date, write "Applied For" and the application date.

Who files Form 941 (sp)?

  • Employers who read Spanish

The header asks for the employer identification number (EIN), the legal business name, any trade name and the address, with every label in Spanish.

  • Aggregate return filers

A box in the header is only for aggregate filers, who mark one type: section 3504 agent, certified professional employer organization (CPEO) or other third party.

  • Employers in U.S. territories

Part 1 says employers in American Samoa, Guam, the Northern Mariana Islands, the U.S. Virgin Islands and Puerto Rico skip lines 2 and 3, unless their employees are subject to U.S. income tax withholding.

  • Seasonal employers and closed businesses

Part 3 has a box for a seasonal employer that does not file a return every quarter, and a box with the last date wages were paid for a business that stopped operating or paying wages.

  • Paid preparers and designees

A paid preparer completes the preparer section on page 2. Part 4 lets the employer name an employee, paid preparer or other person the IRS may speak with about the return.

The employer completes and signs the return and files it with the IRS. A paid preparer, if one is used, fills in the preparer section.
