Form 433-H (sp): Installment Agreement Request, Spanish Version

Form 433-H (sp) is the Spanish version of the IRS Installment Agreement Request and Collection Information Statement. Its Spanish title is "Solicitud de Plan de Pagos a Plazos y Declaración de Ingresos y Gastos". The form and its six pages of instructions are in Spanish. The agency line at the top and the catalog footer are in English.

The instructions say wage earners use it to give the IRS their current financial information and ask to pay over time, so the IRS can decide how best to settle unpaid tax. The top of page 1 says to use it when you earn wages, request an installment agreement, and owe more than $50,000 or cannot pay within 72 months. Part 1 is the payment request. Part 2, Sections A to G, lists accounts, property, debts, income and monthly living expenses.

For $50,000 or less that can be paid within 72 months, the instructions point to Form 9465(SP) instead. You can fill out the PDF free in your browser on this page and download it without an account.

How to fill out Form 433-H (sp)

  1. 1

    Lines 1 to 5

Enter the tax form, period and total owed as shown on your returns or notices, then any other balances, even ones already in an installment agreement. Add them, enter any payment sent with the request, and subtract it.

  2. 2

    Lines 6 and 7

Enter the amount you can pay each month. If line 6 is left blank, the form says the IRS sets a payment from your financial statement. Pick a payment day from the 1st to the 28th.

  3. 3

    Lines 8a to 8c

For direct debit, the routing number has nine digits starting with 01 to 12 or 21 to 32, and the account number can have up to 17 characters. Leave out the check number. A low-income taxpayer who cannot pay by debit checks line 8c.

  4. 4

    Sections A to D

List all accounts even with no balance, but not bank loans. Net value is the current fair market value minus the amount owed. Write N/A in a column that does not apply, and "arrendado" (leased) for a leased vehicle.

  5. 5

    Sections E to G

A copy of a recent pay stub replaces the gross pay and tax lines. Convert bills that are not monthly: divide quarterly amounts by 3, multiply weekly by 4.3, every two weeks by 2.17 and twice a month by 2.

  6. 6

    Sign and date

You and your spouse sign under penalties of perjury. The statement also authorizes the IRS to contact third parties and accepts the plan terms in the instructions if the plan is approved.

Where it goes, fees and what happens next

Where to send it

Mail it with any attachments to the IRS address for your state in the chart: Andover, MA 01810-9041; Doraville, GA 30362; Kansas City, MO 64121-9236; or Philadelphia, PA 19104 for a foreign country, American Samoa, Puerto Rico and the other cases the chart lists.

Decision time

The instructions say the IRS normally tells you within 30 days whether the request is approved, but it may take longer for tax owed on a return filed after March 31.

User fees

The table lists $178 for a plan paid by check, money order, credit card or payroll deduction and $107 for direct debit. Low-income taxpayers may pay a reduced $43, and the instructions say no fee is charged if they agree to direct debit.

Paying with the request

Attach a check or money order payable to "United States Treasury", not cash, with your name, address, SSN or ITIN, daytime phone, and the tax year and form.

Interest, penalties and refunds

Interest and late payment penalties continue until the balance is paid in full. Future refunds are applied to the amount owed, and the monthly payment is still due.

Missed payments

If payments are late or a later balance goes unpaid, the instructions say the IRS can end the plan and act to collect, for example by filing a Notice of Federal Tax Lien or a levy.

Who files Form 433-H (sp)?

  • Wage earners with a large or long balance

The form is for people who earn wages and ask for an installment agreement when the tax owed is over $50,000 or cannot be paid within 72 months.

  • Spouses

The form has spaces for the spouse's SSN or ITIN, phone numbers, employer and pay, and a spouse signature line.

  • Balances of $50,000 or less

If the balance is $50,000 or less and can be paid within 72 months, the instructions point to Form 9465(SP) or the IRS online payment agreement instead.

  • Self-employed people and business owners

The instructions say not to use this form if you are self-employed or operate a business, and point to Form 433-D(SP) instead.

  • Not for bankruptcy or accepted offers

If you are in bankruptcy or the IRS accepted your offer in compromise, the form says not to file it and to call 1-800-829-1040 instead.

The instructions say wage earners complete it and mail it to the IRS service center address for their state. The taxpayer signs it, and a spouse signs on the second line.
