Form 14446 (sp): Virtual VITA/TCE Taxpayer Consent, Spanish Version

Form 14446 (sp) is the Spanish version of Form 14446, Virtual VITA/TCE Taxpayer Consent. The IRS lists it for taxpayers who read Spanish and get help at a Volunteer Income Tax Assistance (VITA) or Tax Counseling for the Elderly (TCE) site. The Spanish title, Consentimiento virtual para la Asistencia Voluntaria con los Impuestos sobre los Ingresos y la Asesoría Tributaria para las Personas de Edad Avanzada, spells out both programs and notes that VITA and TCE are English acronyms. Each footer reads Form 14446 (sp) (Rev. 11-2023). The English edition is Form 14446.

The Spanish text says the form is required when the intake interview or the quality review is not done in person between the taxpayer and the VITA/TCE volunteer. The site completes Parte I and Parte II. The taxpayer reads Parte III, answers two Sí or No questions and signs, and on a joint return both spouses sign.

Site name, site address (street, city, state, ZIP code), site identification number (SIDN), site coordinator name, and the site contact's name and phone number.

Virtual methods A to E

Sitio de entrega (drop off site), Sitio de admisión (intake site), a return preparation or quality review only site, Sitio de combinación (combination site), and the 100% virtual VITA/TCE process.

Parte II: the site's process

Eleven numbered processes, each with a guide question in parentheses: scheduling, the consent agreement, intake, identity checks with photo ID and Social Security cards or ITIN letters, interview, preparation, contact, quality review, sharing, signing and e-filing.

Parte III: accuracy review

The form says IRS employees pick free tax preparation sites at random for review, the site makes any needed corrections, and saying no does not affect the services provided at the site.

Virtual consent disclosure

Says that if non-IRS virtual systems are hacked or breached without the site's knowledge, federal law may not protect the return information from further use or distribution, and that the sites may not be on federal property.

Consent and signatures

A Sí or No on using the site's virtual VITA/TCE process, then printed name, date of birth, date, phone, email and an electronic or a typed/printed signature, in columns for the taxpayer and the spouse.

How to fill out Form 14446 (sp)

    Parte I (site)

The site enters its name, address, SIDN, coordinator and contact, then checks each virtual method, A to E, that it uses.

  2. 2

    Parte II (site)

For each of the 11 processes, the site writes how it is handled remotely. Item 10 asks whether the taxpayer signs in person or electronically, and which software is used to sign.

Check Sí (Yes) or No on letting an IRS employee check the return for accuracy if the site that prepares it is selected.

Kept at the site

The Spanish text says page three of the form is kept at the site with all other required documents. No IRS mailing address is printed.

How long consent lasts

The disclosure says consent is valid for the amount of time the taxpayer specifies, or for one year from the date of signature when no duration is specified.

If the taxpayer does not sign

The Spanish text says that if the taxpayer chooses not to sign, the site may not be able to prepare the return through this process.

Reporting misuse

English edition

Form 14446 is the English edition. The Spanish footer carries the same Rev. 11-2023 date, and the header gives it in Spanish as Noviembre de 2023.

Who completes Form 14446 (sp)?

  • Spanish-speaking taxpayers

The IRS lists this edition as the Spanish Version of Form 14446. It is a Spanish-only form, not a bilingual one: the labels, method descriptions and consent text are all in Spanish.

  • VITA/TCE site

Parte I is headed as completed at the VITA/TCE site. The form says the site explains to the taxpayer the process used to prepare the return and, where it applies, the risk of moving data from one site location to another.

  • Taxpayer

Reads Parte III, answers whether an IRS employee may check the return for accuracy, answers whether to use the site's virtual process, and signs.

  • Spouse on a joint return

The consent text says both spouses sign and date the document on a married filing jointly return. The second column is labeled for the spouse if married and filing a joint return.

  • Drop off taxpayers who leave

The note under method A says a taxpayer who leaves tax documents at the site and then leaves the site's property for any reason completes Form 14446. Waiting in another room or a vehicle does not count.

The VITA/TCE site fills in Parts I and II. The taxpayer, and a spouse on a joint return, fill in Part III. The form says page three stays at the site.
