Form 8881: Credits for Small Employer Pension Plan Startup Costs and Related Credits

Form 8881, Credits for Small Employer Pension Plan Startup Costs, Contributions, Auto-Enrollment, and Military Spouse Participation, is a business credit form attached to the employer's tax return. The instructions say eligible small employers use Part I to claim the credits for qualified startup costs incurred in establishing or administering an eligible employer plan, including for employer contributions, under section 45E.

Part II is for the credit for an eligible automatic contribution arrangement in a qualified employer plan under section 45T, and Part III is for the credit for a military spouse's participation in an eligible defined contribution plan under section 45AA. Partnerships and S corporations report the totals on Schedule K, and all others carry them to Form 3800.

How to fill out Form 8881

  1. 1

    Line A

The instructions say to enter the number of employees who received at least $5,000 of compensation during the tax year before the first credit year. Line 2 is figured from this number: employers with 1 to 50 employees enter line 1, and employers with 51 to 100 enter 50% of line 1.

  2. 2

    Line 3

Enter the number of non-highly compensated employees eligible to participate in the plan during the tax year, multiplied by $250. Line 5 is the smaller of line 2 or line 4.

  3. 3

    Lines 6a to 6d

Line 6a is the number of employees in the preceding tax year. Line 6b leaves out elective deferrals, contributions for employees paid wages over $105,000 and contributions over $1,000 to one employee. Line 6c covers those over $1,000 using the per-year caps in the instructions.

  4. 4

    Lines 6e to 6g

With 51 to 100 employees on line 6a, lines 6e(1) to 6e(4) reduce the amount by 2% for each employee over 50. Line 6g applies 100% in years one and two, 75% in year three, 50% in year four and 25% in year five.

  5. 5

    Lines 9, 12 and 13

Enter $500 on line 9 if an auto-enrollment option is provided. On line 12, count only military spouse employees who meet the participation rule in the instructions, and on line 13 enter no more than $300 per employee.

  6. 6

    Controlled groups

The instructions say members of a controlled group or businesses under common control are treated as a single employer. A member enters its share, attaches a statement showing how it was figured and writes "See Attached" next to the line.

Where it goes and what to know

Attach to the tax return

The form says "Attach to your tax return." It is filed with the employer's return, not mailed on its own.

Where the totals go

Partnerships and S corporations report lines 8, 11 and 15 on Schedule K. All others report them on Form 3800, Part III, lines 1j, 1dd and 1ee.

How many years

The instructions say the startup costs credit and the auto-enrollment credit apply for the first credit year and the following 2 tax years. The contributions credit covers the first year and the succeeding 4 tax years. The military spouse credit is limited to 3 successive tax years per employee.

No double deduction

The instructions say the deduction for startup costs is reduced by the credit on line 5, and the deduction for employer contributions is reduced by the credit on line 6g.

Electing out

The instructions say the section 45E credit can be left unclaimed for the tax year it is available, which is an election to have section 45E not apply for that year.

Who completes Form 8881?

  • Small employers starting a plan

Part I, Section 1 is for qualified startup costs paid or incurred in establishing or administering an eligible employer plan, or for retirement related education of employees about the plan.

  • Employers making plan contributions

Part I, Section 2 is for employer contributions, not counting elective deferrals, to an eligible employer plan other than a defined benefit plan, for tax years beginning after 2022.

  • Employers with auto-enrollment

Part II is for an employer that first includes an eligible automatic contribution arrangement in a qualified employer plan.

  • Employers of military spouses

Part III is for eligible small employers whose military spouse employees participate in an eligible defined contribution plan. The form says it cannot be claimed with more than 100 employees in the preceding tax year.

  • Partners and shareholders

The instructions say taxpayers other than partnerships and S corporations whose only source of these credits is a partnership or S corporation are not required to complete or file this form. They can report the credits directly on Form 3800.

Form 8881 is completed by an employer, not by plan participants. Each credit has its own eligible employer test in the instructions, based on having no more than 100 employees who received at least $5,000 of compensation in the preceding tax year.
